Rental Lease Agreement

This is a Binding Contract

  1. This undersigned Lessee(s) hereby acknowledges receipt of, and agrees to rent the above listed property from FINNIMORES CYCLE SHOP (herein referred to as "Lessor") for the term and rental shown. At the end of the rental term Lessee agrees to return the property to Lessor at Lessor's place of business, at the address show above, in as good condition as received, reasonable wear and tear expected.
  2. Lessee acknowledges that Lessee has determined that the property is suitable for the use intended, and that Lessee has inspected the property and accepts the same as delivered. Lessee acknowledges that Lessor has made no representations or warranties, oral or written, express or implied, in connection with the property.
  3. Lessee agrees not to lend or sublease any of the property or allow any other person or persons to operate or use it. Lessee agrees that in the event of the breach of any of the terms of this agreement by Lessee, Lessor may immediately take possession of the property without payment of any refund that may or might become due to Lessee.
  4. Lessee acknowledges that operation of the leased property entails the nsk of accidental bodily injury to Lessee or Lessee's passengers and damage to their personal property. Lessee assumes complete and sole risk for all injuries and property damage incurred by Lessee or Lessee's passengers as a result of operation of the leased property.
  5. Lessee shall use the property in a careful and proper manner and shall comply with all local and state regulations, statutes, and laws dealing with its operation, use and possession.
  6. Lessee assumes the entire risk of loss, theft or damage to the property during the term of this agreement, whether or not covered by insurance, and no such loss, theft or damage shall relieve Lessee of Lessee's obligations hereunder. In the event of loss, theft or damage to the property, in whole or in part, Lessee shall promptly notify Lessor.
  7. Lessee agrees to indemnify and hold Lessor, its agents and employees, harmless from and against all liabilities, claims, damages, losses, costs and expenses (including reasonable attorney fees and court costs) for all injuries to or death of any person, or damage to any property arising, directly or indirectly, from Lessee's possession, use and return of the leased property.
  8. This undersigned lessee(s) hereby acknowledges receipt of, and agrees to rent the above listed property from FINNIMORE'S CYCLE SHOP (herein referred to as "lessor") for the term and rental shown.   11. Lessee acknowledges that operation of the leased property entails the risk of accidental bodily injury to lessee or lessee's passengers and damage to their personal property. Lessee assumes complete and sole risk for all injuries and property damage incurred by Lessee or Lessee's passengers as a result of operation of the leased property.
  12. Lessee shall use the property in a careful and proper manner and shall comply with all local and state regulations, statutes, and laws dealing with its operation, use and possession. Lessee understands that RIDING ON THE BEACH IS PROHIBITED BY LAW.
  13. Lessee assumes the entire risk of loss, theft or damage to the property during the term of this agreement, whether or not covered by insurance, and no such loss, theft or damage shall relieve Lessee of Lessee's obligations hereunder. In the event of loss, theft or damage to the property, in whole or in part, Lessee shall promptly notify Lessor.
  14. Lessee agrees to indemnify and hold Lessor, its agents and employees, harmless from and against all liabilities, claims, damages, losses, costs and expenses (including reasonable attorney fees and court costs) for all injuries to or death of any person, or damage to any property arising, directly or indirectly, from lessee's possession, use and return of the leased property.
  15. Lessor is not responsible for refunds on early returns due to any weather-related issue.
  16. Lessee agrees to a $3.00 CHARGE FOR THE LOSS OF A KEY, LOCK OR CABLE; therefore, Lessee is advised to KEEP KEYS IN YOUR POCKET.
  17. LIGHTS REQUIRED FOR RIDING AFTER SUNSET.

  18. Cancellation Policy: If you cancel outside of 30 days you'll receive a refund minus a $30 administrative charge. Cancelling inside of 30 days will count as a credit towards a future purchase.
